2. Acceptance of these terms

By accessing this website, creating an account, or placing an order, you agree to be bound by these Terms of Service, together with our Privacy Policy, Refund & Returns Policy and Shipping Policy, which are incorporated by reference. If you do not agree, please do not use this website.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to purchase from this website. Our products are not intended for use by persons under 18 without the supervision of a qualified healthcare professional. By placing an order you confirm that you meet these requirements.

4. Our products

We sell food products and food supplements containing functional mushrooms, cacao and related botanical ingredients.

Our products are foods and food supplements. They are not medicines. They have not been evaluated or registered by the South African Health Products Regulatory Authority (SAHPRA), and they are not intended to diagnose, treat, cure or prevent any disease or medical condition. Nothing on this website constitutes medical advice.

Individual responses to supplements vary and we make no guarantee of any specific result, benefit or outcome. You should consult a qualified healthcare professional before use, particularly if you are pregnant, breastfeeding, taking any medication, or managing a medical condition. Full ingredient information is provided on each product page and on the product packaging — it is your responsibility to check this before purchasing and consuming, especially where you have a known allergy or sensitivity. If you experience an adverse reaction, stop using the product immediately and seek medical advice.

5. Product information and availability

We take care to describe our products accurately, but we do not warrant that product descriptions, images, colours, packaging or other content are complete, current or error-free. Product images are illustrative and packaging may vary. All products are subject to availability, and we may limit quantities, discontinue a product, or decline or cancel an order at our discretion.

6. Pricing

All prices are shown in South African Rand (ZAR). We reserve the right to change prices at any time without notice; the price applicable to your order is the price displayed at the time you place it.

In the event of an obvious pricing error, we reserve the right to cancel the affected order and refund you in full, whether or not the order has been confirmed.

Prices exclude delivery charges, which are calculated and displayed at checkout. For international orders, import duties, taxes and customs charges are not included and are your responsibility.

7. Orders and formation of contract

Your order is an offer to purchase. Our acknowledgement of your order does not constitute acceptance. A binding contract is formed only when we dispatch the goods to you. We may decline an order for any lawful reason, including suspected fraud, stock unavailability, pricing error, or where we cannot lawfully supply the products to your delivery address.

8. Payment

Payment is processed by our third-party payment provider. We do not receive or store your full card details. You warrant that you are authorised to use the payment method you provide. Orders are only processed once payment has been authorised in full.

9. Delivery

Delivery terms, timeframes and charges are set out in our Shipping Policy. Delivery timeframes are estimates and are not guaranteed. Risk in the goods passes to you on delivery to the address you provide.

10. Returns and refunds

Returns and refunds are governed by our Refund & Returns Policy, which forms part of these terms. Because our products are ingestible, restrictions apply to opened or unsealed items.

11. International orders and restricted goods

Where we ship internationally, you are the importer of record. It is your responsibility to confirm that the products may be lawfully imported into and possessed in your country before ordering. We are not liable for goods seized, delayed or destroyed by customs, and such orders are not refundable.

12. Intellectual property

All content on this website — including text, product descriptions, photography, graphics, logos and the Thriving International name and branding — is owned by or licensed to Thriving Global Wellness (Pty) Ltd and is protected by South African and international intellectual property law. You may not reproduce, distribute or commercially exploit any of it without our prior written permission.

13. Acceptable use

You agree not to use this website for any unlawful purpose; to attempt to gain unauthorised access to our systems; to introduce malicious code; to scrape or harvest data; to place fraudulent orders; or to infringe the rights of any person.

14. Third-party links

This website may link to third-party websites. We do not control and are not responsible for their content, products or privacy practices.

15. Limitation of liability

To the maximum extent permitted by law, and subject to clause 16, our total liability arising out of or in connection with any order is limited to the amount you paid for the products in question. We are not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue or data.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded.

16. Your consumer rights

These terms operate in addition to, and do not exclude, restrict or waive, any rights you have under the Consumer Protection Act 68 of 2008, ECTA, or other applicable mandatory consumer law. Where any provision of these terms conflicts with such a right, the law prevails to the extent of the conflict.

17. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of the website, or your use of our products otherwise than in accordance with the directions and warnings provided.

18. Privacy

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

19. Severability and waiver

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it.

20. Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate's Court having jurisdiction, notwithstanding that the claim may exceed that court's monetary jurisdiction.

21. Changes to these terms

We may update these terms from time to time. The version in effect at the time you place your order applies to that order. The current version is always available on this website.
